EL FUEGO TANGO MARATHON REGULATIONS

1. General provisions
1.1 The El Fuego Argentine tango marathon, hereinafter referred to as the “Marathon” or “Event” is a private and closed cultural event organised by Andrzej Bernaś, Warszawa, ul.Kopińska 36A/57 NIP: 8951668397
1.2 Event venue: Warsaw, ul. Poligonowa 32
1.3 Duration of the event: 1-3 November 2019
1.4 The marathon programme is available on the official website of the event: https://elfuegomarathon.eu/en/schedule
1.5 The person taking part in the Event is hereinafter referred to as the “Participant”.
1.6 The provisions of the present regulations constitute an integral part of registration to the Marathon and are binding for each Participant during the whole event.

2. Registration rules
2.1 The condition for participation in the El Fuego marathon is:

  • registtering by filling out the application form at https://elfuegomarathon.eu/en/registration,
  • making a timely payment for participation in the event, following the Organiser’s instructions,
  • receiving a message from the Organiser, confirming participation in the marathon along with information about being added to the main list of marathon participants.

2.1 Registration is made for the whole event. Tickets for part of the event, e.g. one day, are not provided.
2.2 The data provided in the form should be confirmable with the Participant’s Identity Card at the first arrival at the event. The Organiser will not admit any person whose personal data cannot be verified, or whose data (e.g. gender) provided during registration are not true, to the event.
2.3 The form accepts applications in couples (Woman + Man) or solo (without a Partner); applications submitted by couples are considered in the first place.
2.4 When registering as a couple, each partner fills out the form on their own, providing the other person’s name and e-mail in the Your Partner’s Data field.
2.5 Solo registrations are added to the Waiting List.
2.6 The organiser will inform the people from the waiting list about the transfer to the main list in the case of:
availability of a place on the main list,
possibility of matching people from the waiting list into couples.
2.1 Do not book your accommodation, flight etc. before receiving a clear message confirming your participation in the marathon from the Organiser.

3. Terms of payment
3.1 The payment for participation in the marathon should be made within 7 working days of the date of receipt of the message with the data necessary for the transfer. Lack of timely payment is equivalent to the cancellation of the reservation for both partners from the couple.
3.2 The marathon fee does not include the accompanying events: Pre-Party (on Thursday) and After-Party (on Monday).
3.3 The marathon fee does not include the Participant’s transport and accommodation.
3.4 The Organiser does not bear the costs of bank commissions, card payments or currency conversion costs.
3.5 The fee applies only to the current edition of the event and cannot be transferred to future editions of the marathon.

4. Rules applicable to Participants during the event
4.1 At the first entry to the event area, each Participant receives a marathon wristband. The band is given only to people who are on the main list.
4.2 The band entitles its wearer to take part in the marathon; it is obligatory to wear it during the whole event.
4.3 Any person present in the event area without a wristband will be asked to leave.
4.4 In case of damaging the band due to reasons beyond the control of the Participant, such a person should immediately report to the marathon office – located at the entrance to the event area – in order to have the band replaced with a new one.
4.5 A band which has been removed, shows signs of removal or has been passed on to another person outside the main list of participants, loses its validity. People with such a band will be asked to leave the marathon without permission to return to the event.
4.6 All Participants of the marathon are obliged to observe the principles of good manners and social norms.
4.7 Anybody behaving in an aggressive way or remaining under the influence of alcohol or psychoactive substances will not be allowed into the marathon area.
4.8 Smoking is not allowed in any part of the facility in which the marathon is held.

5. Transfer (resale) of the Participation
5.1 Participation cannot be transferred to another person without the Organiser’s consent.
5.2 Prior to resale, the first owner notifies the Organiser of the change by sending an e-mail in which they provide the new owner’s name, surname and e-mail address.
5.3 In the case of exchange of participation, there is no 14-day refund period.
5.4 Resale/transfer of participation is possible up to 14 days before the start of the event.
5.5 The Organiser does not look for a person interested in buying the participation. Both people settle the accounts between them.

6. Cancellation of Participation
6.1 The marathon payment is connected with a 14-day refund period. After 14 days of the date of purchase, no refunds will be made, regardless of the reason. This also applies to fortuitous events affecting the Participant.
6.2 Returns are transferred to the cancelling person’s account within 14 days of the end of the event, in the amount and currency as stated in the transaction confirmation received from the Organiser’s bank.
6.3 In case of need of cancellation, the Participant should immediately contact the Organiser.
6.4 Up to 14 days before the event start date, the Organiser offers help with finding a replacement by putting the cancelling person in contact with the person/people from the Waiting List.
6.5 After putting the interested people in contact, the Organizer does not interfere with the arrangements between them, including the payment.

7. Responsibility of the Organiser
7.1 The Organiser is responsible for the proper course of the marathon, in accordance with the programme.
7.2 If the event does not take place due to reasons attributable solely to the Organiser, the Organiser will refund the entire amount paid by the Participant to the bank account indicated by them within 14 working days from the date of the event.
7.3 In the event that the Marathon does not take place due to reasons beyond the Organiser’s control, the Participant is not entitled to compensation or refund of any fees related to their participation in the Marathon.
7.4 In special cases, the Organiser may change the date and place of the Marathon. The Participant is not entitled to compensation or refund of any fees related to the participation in the Marathon due to the change of date or place of the event.
7.5 The Organiser is not liable for any damage to the Participant’s health, caused by other Participants’ actions.
7.6 The Participants bear full financial responsibility for property damage caused by them in ​​the marathon area.
7.7 The Organiser is not responsible for the Participants’ belongings which may be lost, damaged or stolen during the Marathon.

8. Personal Data Protection
8.1 The rules for processing and protecting the Participants’ personal data are governed by the Privacy Policy.
8.2 The Participant acknowledges and accepts that their image may be recorded during the event, in the form of photos and video recordings.
8.3 The Organiser may record the course of the Event for documentation, advertising and promotional purposes, for the use of the Organiser or sponsors of the Event. The Organiser or, respectively, a sponsor may use such recording or its fragment, including one representing an image of the Participant, without restrictions as to time and territory and without the need to pay a fee for the use of the image, in all fields of exploitation, including those specified in Art. 50 of the Act on copyright and related rights, especially through recording, reproduction, circulation and dissemination.

9. Final Provisions
9.1 The Organiser reserves the right to change the rules and programme of the event.
9.2 The Organiser informs that the Participant staying in the event area may be exposed to remaining in the zone of significant sound intensity, which may in exceptional cases affect their health or well-being.
9.3 The Organiser reserves the right to remove a person violating the Regulations from the facility in which the marathon is held, without the right to return to the marathon area or to demand reimbursement of any expenses incurred in connection with participation in the event, including the participation fee.
9.4 Any disputes which may arise in connection with the participation in the Marathon will be settled by the court competent for the Organiser’s registered office.
9.5 The Regulations are available on the website https://elfuegomarathon.eu/en/rules, at the Organiser’s office and during the marathon, at the entrance to the event area.
9.6 In matters not covered by the Regulations, Polish cywil code shall apply.
9.7 The Regulations come into force on the day of their announcement and are valid until the Organiser officially closes the Event.
